International Maritime Law Instituteにおける講義

兼原研究主幹は、2026年4月7日に、International Maritime Organizationの研究・教育機関であるInternational Maritime Law Institute（マルタ）において、“PROTECTION OF UNDERSEA INFRASTRUCTURE- THE RIGHT TO PROTECT USES OF OCEAN”と題する講義を行いました。講義概要は、以下のとおり。

1. Introduction喫緊の課題としての海底ケーブル・パイプラインの保護―損壊事例の世界的な多発
2. UNCLOSの検討を中心として、既存法の欠陥・欠缺を踏まえて、既存法の修正・変更および新法の創造の必要性を認識
3. （既存法の修正・変更および新法の創造のための基盤となる検討として）海底ケーブル・パイプラインの特徴を、次の6点に即して検討
   ①機能の多様性、②有害行為、③損壊により法益侵害を受けるstakeholder(s)の多様性、④責任主体、⑤損壊行為が「武力の行使」「武力攻撃」に該当する可能性、⑥武力紛争法上の論点
4. 「海洋の利用を保護する権利」を根本にすえて、海洋法の一分野としての「海底ケーブル・パイプラインを保護する法」の立論
5. Ending　海底ケーブル・パイプラインの機能やstakeholdersの多様性に鑑みて、一般法の可能性の検討を継続すべきことを宣言
